重要信息 - 在使用PLEX网站、PLEX软件、移动设备或WEB应用程序（S）之前或之后请阅读以下服务条款（参阅本文中的“TOS” ）或任何PLEX相关的服务（在此统称为“Plex Solution”）。 PLEX GmbH（“Plex”）PLEX GmbH愿意在符合本服务条款要求的前提下许可用户使用Plex Solution。使用或以其他方式访问Plex Solution即表明您接受并同意本服务条款。如果您不同意此服务条款，请勿使用Plex Solution。

1. 许可 。
   1. 1.1. Plex Solution概述。欲获取更多的当前可用的Plex解决方案信息，请点击此处。在Plex提供产品和服务的国家或地区，依照本服务条款，位于此类国家或地区的用户（而非实体机构）均可使用 Plex Solution。
   2. 1.2. General Plex Solution Grant. The Plex Solution is made available by Plex, and this TOS provides to you (identified herein as “you” or a “user” or with “your” (as further described below)) a personal (non-commercial), revocable, limited, non-exclusive, nontransferable, and non-sublicensable license to access and use the Plex Solution (by you and your Authorized Users (as defined below)) conditioned on your continued compliance with this TOS. You may print and download Plex materials and information from the Plex Solution solely for your personal use, provided that all hard copies contain all copyright and other applicable notices contained in (or that are required to be displayed with) such materials and information and that you (or your Authorized User(s)) do not further distribute or disclose such materials and information. The content layout, formatting, and features (or functionality) of and online or remote access processes for the Plex Solution shall be as made available by Plex in its sole discretion. You also acknowledge and agree to the following: (i) Plex has the right to control and direct the means, manner, and method by which the Plex Solution is provided; (ii) Plex may, from time to time, engage independent contractors, consultants, or subcontractors to aid Plex in providing the Plex Solution or use thereof; and (iii) Plex has the right to provide the Plex Solution to others.
   3. 1.3.PMS软件下载。Plex会通过Plex Solution或作为其一部分来向您提供可下载软件或者移动应用程序，以便您关联使用个人媒体管理 (“PMS 软件”)。PMS软件使用权作为上述许可的一部分，以便用于与服务条款一致的Plex解决方案，并应符合以下附加条款的要求。您只能在您现有或控制的设备或硬件上使用PMS软件，将其作为Plex Solution或其他Plex服务的一部分来使用。您在此确认，PMS软件也许会包括或允许与某些第三方可执行组件融合的服务内容，这些组件遵守附加证书条款的相关规定。点击这里获取更多关于这些组件的信息，但除非另有说明，否则，本文此处所指的Plex Solution应包含任何您使用的PMS软件和集成第三方可执行组件。
   4. 1.4. Content Available Through the Plex Solution. In connection with the foregoing grant to use the Plex Solution, the Plex Solution allows you to view or otherwise access original Plex or third party Content. “Content” includes, but is not limited to, text, graphics, photos, sounds, audio, and videos in the form of, by way of example and not limitation, news reports, podcasts, videos, and music. The availability of such Content may change and not all Content is available in all formats. Use of the Content is subject to the license grant for the Plex Solution, but in addition, shall remain non-transferable and may be subject to additional license grant terms set by the respective third party licensor(s). Third-party Content displayed or accessible through the Plex Solution is protected by copyright and other intellectual property law and belongs to the respective owner(s) or licensor(s). This TOS does not grant you the right to copy (further), distribute, prepare derivative works, publicly display, or otherwise use any Content. You are expressly prohibited from engaging in or facilitating the unauthorized sharing or distribution of Content.
   5. 1.5. Plex解决方案更新。Plex可能（但无义务）对Plex Solution进行更新、升级、改进、提升、补充或添加新功能（由Plex单方面决定是否更新），一般通过Plex Solution完成此类操作。或者通过产品支持团队提供的修改、其他Plex提供的支持服务以及作为Plex解决方案的一部分或者与其关联的维护服务的一部分来完成（合称为 “Plex Solution更新”）。在某些情况下，您可能会被要求许可或同意使用或执行及时的可适用Plex解决方案更新，包括但不限于作为保护Plex的一种措施，防止未授权使用内容或数据。如果您拒绝Plex Solution更新，您可能无法使用或访问Plex Solution（部分或全部），Plex也不会为您后续使用承担任何责任或义务。除非另有说明，否则，此处所指的Plex Solution包括任何Plex Solution更新。
   6. 1.6. 支持。本服务条款并不提供任何安装服务的支持（合称为”支持“）。Plex提供的任何此类支持应当依据其他Plex单独条款和情况酌情决定。
   7. 1.7. Authorized User(s). Subject to any third party license restrictions for applicable Content, you may enable members of your immediate family over the age of thirteen (13) and for whom you will be responsible (each, an “Authorized User(s)”) to access and use the Plex Solution so long as all such use remains in compliance with this TOS. Nevertheless, you acknowledge and agree that you shall be responsible for monitoring your own and your Authorized User(s)’s use of the Plex Solution and for maintaining compliance with this TOS and any third party license restrictions for applicable Content. Any breach of this TOS by an Authorized User(s) shall constitute a breach by you. Unless otherwise indicated, references to “you” or “your” throughout this TOS therefore mean you, your Authorized User(s), and the person or entity named on your account with Plex.
2. 许可授权限制。此份服务条款仅为许可，不得转让或出售。Plex不会将Plex解决方案中或相关所有权、知识产权权益或知识产权所有权转让给您或任何人。此外，Plex保留所有此服务条款未明确声明授予的所有权益。因此，您不能修改、翻译、反编译、创作衍生产品、复制、发布、反汇编、广播、传播、出版删除或更改任何专有声明或标签、证书、从属证书（授权用户除外）转让、出售、设计、利用、租赁、出租、私人标签、安全利益许可以及其他任何Plex解决方案（或Plex）未声明许可的方式。特别是（不限于上述情况），您无权进一步发布公开PMS软件或超出上述许可限制进行操作。还有，该服务条款不授予用户任何修改PMS软件的权利，也不向任何第三方可执行组件或超出此处声明限制的许可以外的可访问内容提供授权或许可。
3. 接口软件。“接口软件”是指您自行获得或其他方为您提供的、用于访问或调用由Plex提供的任何PMS软件的软件，此类软件作为Plex Solution的一部分，包括但不限于Plex Solution的插件、通道插件、元数据代理以及直接或间接与Plex Solution通信的客户应用程序。您应对任何接口软件负责，包括通过接口软件进行的任何数据收集行为。Plex鼓励您执行、遵守实质上与Plex的隐私政策（如下文所述）相似的数据收集与使用政策。开发任何接口软件或协助其他方开发或为其提供任何接口软件即表示您授予Plex非专属免费许可权，允许Plex使用（包括测试、代管、链接）、复制、公开使用、公开展示（包括屏幕截图）、为分发而复制、营销或推广（作为Plex Solution或Plex其它服务的组成部分）、分发任何接口软件（或相关名称）副本。您特此同意提供并纳入（或链接至）一份符合下述Plex隐私政策的隐私声明并在接口软件的源代码中包含一份采用下列形式的版权声明：版权所有© <year> <copyright holders>。Plex的任何数据收集行为均应符合Plex隐私政策（如下文所述）。在Plex将许可内容纳入本声明（如果您首先为Plex提供许可）的情况下，您特此授予或同意Plex代表您授予（如必要）任何人一项免费许可，允许此人通过Plex获得接口软件的副本和相关文件、在不受任何限制的情况下处理接口软件（包括但不限于使用、复制、修改、合并、公布、分发、转许可和/或销售接口软件副本的权利），并且将上述权利授予收到许可软件的其他人。您在此表述并保证您拥有提供上述授权的一切必要权利，并且进一步同意按照符合本服务条款和Plex Solution使用要求的方式使用、集成接口软件。如果您不希望Plex使用您开发、拥有的接口软件，您可以将您的意见告知我们（请点击此处）。任何此类通知必须包含一切必要信息和表述（如Plex所述）。Plex将按照您的要求停止使用接口软件，但Plex在收到您的要求之后需要至少30天的过渡期才能完全停止使用软件。但是，Plex没有义务确认您或Plex无法控制的其他人（包括授权用户）删除或停用接口软件。
4. GENERAL USER OBLIGATIONS. You represent that you are at least eighteen (18) years of age (or the legal age of majority, whichever is greater) and will, at all times, provide true, accurate, current, and complete information when submitting information or materials on or through the Plex Solution, including, without limitation, when you provide information via a Plex Solution registration, account, or submission form. You are responsible for completing any registration(s) or account requirements for access to applicable third party Content available through the Plex Solution. Individuals under the age of eighteen (18) (or the applicable age of majority) may utilize the Plex Solution only with the involvement and acceptance of (this TOS by) a parent or legal guardian and then solely as an Authorized User under a parent or legal guardian’s account. You further represent that you (or the person agreeing to, accepting, or acting under this TOS) are authorized to act on behalf of the person or entity named on the account with Plex. In addition, you agree to abide by all applicable local, state, national, and international laws and regulations with respect to your use of the Plex Solution. In particular, you may not take any action that will infringe on the intellectual property rights of Plex or any other third party. You acknowledge that unauthorized use of copyrighted content of others may subject you to civil and criminal penalties, including possible monetary damages, for copyright infringement. You also acknowledge and agree that use of the Internet and the Plex Solution is solely at your own risk. You further understand that by using the Plex Solution you may encounter content that you may find offensive, indecent, or objectionable. You assume all responsibility for obtaining and paying for all licenses and costs for third-party software and hardware necessary for access to the Plex Solution, and for maintaining and backing-up your content and data.
5. 用户内容以及许可使用 。Plex Solution让您能访问内容、数据、通信以及其他互动功能（上传、下载、分享或者交换信息或此处统称为“用户内容”的内容）。用户内容发布应符合第三方权益。您在此同意，您将不会上传、发布、显示或者传播如下内容：
   • 任何诽谤、骚扰、威胁、冒犯或以任何方式损害或侵犯他人权利（包括但不限于专利、版权以及商标权）的内容；
   • 任何可能损害Plex及其服务的商誉或声誉的行为;
   • 任何涉及冒充其他人或公司的内容;
   • 任何构成病毒或有害程序代码、文件或软件的内容;
   • 任何构成垃圾邮件，或未经授权的广告的内容；
   • 任何非法内容。

   Plex自行保留建立与任何用户内容显示或可用性有关的额外操作、参数和限制的权利。此外，Plex没有义务合并或使用不符合技术或使用操作、参数和限制规定的任何用户内容。

6. 使用用户内容许可。您可以继续保留您在Plex和/或Plex Solution用到的用户内容中的任何所有权益。然而，通过提交或提供任何类型的用户内容，您被视为自动授予Plex免版税、可转让、有从属许可的非独有权益和许可，允许Plex进一步使用或操作此类用户内容，并与Plex Solution操作关联。您授予的权利被仅用于提供和操作Plex Solution的目的。您明确承认Plex Solution将促进用户内容发布。作为上述授权的一部分，当您通过Plex Solution功能许可时，您允许任何与您分享内容的用户获得非独有的许可，以通过Plex Solution访问并使用用户内容。您在此表示您拥有做出上述许可和为（或通过）Plex Solution向Plex提供用户内容的权利。
7. 用户内容无需预审；删除 Plex不负责预审或编辑您及其他任何用户提供的用户内容，也不负责在论坛发帖或者进行其他交流以鼓励所有用户合理谨慎判断评估审查任何此类内容或者交流。此外，Plex不认可、不承认、不修改您及其他用户提供的观点或者信息（除非特别注明由Plex单独提供），也不会作出任何相关表述，也不会为您或者其他用户展示、上传的或发布的用户内容或交流内容的准确性、完整性、质量、可接受性、完备性、及时性、合法性、可持续性及可信度提供任何保证。发布、分享或展示相关内容之后，您确认Plex无法控制任何一方或任何一个人对于概念、内容或者信息的使用程度。虽然如此，Plex仍然保留在用户内容（或文中提到的部分）、论坛发帖或任何Plex认为合理且有必要的沟通的控制范围内采取措施的权利：(i)满足所有适用法律、规定、诉讼程序以及政府要求；(ii) 执行该服务条款，例如上文所指的潜在暴力行为调查；(iii) 检测、预防并处理欺诈、安全及技术问题；(iv)处理用户支持请求；(v) 保护Plex及其用户或者公众的权利、所有权和人身安全或；(vi) 处理任何确实违反了Plex服务条款及/或可能违法或者损害Plex、其服务或商誉的行为或者不作为。
8. 账户。您可能会被要求提供某些个人信息以供创建Plex账户。您可能会需要创建登录凭证，比如用户名和密码。有时您也需要遵守其他由Plex自行规定的特定访问要求。您仅为您账户的活动负责，您同意保护您登录凭证安全和机密。您了解Plex不会提供控制以限制通过Plex解决方案可获得的内容级别。如果您允许您的孩子（18周岁或法定年龄以下）访问您的Plex账户，您将全权负责监护您孩子使用Plex解决方案，并决定您孩子合适访问的内容级别。如果您怀疑或意识到任何遗失、盗窃或任何您访问凭证的未授权使用情况，您应当立即通知Plex。
9. 订阅与销售。
   1. 9.1. Subscription. Plex currently offers access to the Plex Solution at no cost. However, Plex may make available fee-based subscription offering(s). Please click here for more information. The subscription cost, subscription term, available trial period (if any), renewal information, and permitted payment methods will be specified at the time of order. All subscriptions are billed immediately in advance and are final unless otherwise indicated by Plex or as may be required under applicable law. There will be no refunds or credits for partial months, upgrades/downgrades, or nonuse.
   2. 9.2. Subscription Changes & Renewal. Subscription fees are subject to change (with prior notice) and shall apply to the upcoming renewal period (if any) as indicated. Such notice may be provided by email or by posting the changes to your Plex account, the Plex website, or through the Plex Solution. When you enroll in any recurring subscription arrangement, you authorize Plex to automatically charge the billing source you provided Plex at the time you enrolled for the subscription term specified (at the time of enrollment) until the subscription ends or you cancel your enrollment. To avoid being charged for the next renewal period, you must cancel at least one (1) day prior to the end of the then-current Plex subscription term. You may cancel by clicking here. For any change (upgrade or downgrade) in your subscription that you make or request, your fee and method of payment will be automatically adjusted and charged (as applicable) at the new rate on your next billing cycle. Downgrading your subscription may cause the loss of content, features, or capacity of your account.
   3. 9.3. Payment. Plex shall charge and you shall be responsible for payment of all taxes, tariffs, levies, or duties (except that Plex does collect VAT in certain countries). Unless otherwise indicated by Plex in writing, all amounts are immediately due and payable upon order (or renewal). Upon placing an order, you therefore agree to pay using the payment method indicated and grant authorization to Plex to charge the applicable (fee) to your payment provider. All transactions, however, are void where prohibited by law and Plex may request particular information in order to confirm the order and method of payment. Plex also reserves the right to terminate or suspend access to the Plex Solution if you fail to pay any amounts when due. Unless otherwise specified herein, all obligations with respect to the amounts due to Plex under the TOS shall survive any expiration or termination of the TOS.

11. 第三方内容。通过Plex Solution显示或访问的第三方内容受版权和其他知识产权法保护，属于其各自所有者。第三方内容的使用应当符合第三方通过类似内容的有关条款规定。本服务条款不授权您复制、发布、创作衍生作品、公开发布或以其他方式使用第三方内容的权利。您将明确禁止参与或帮助未经授权方共享或发布第三方内容。
12. 保密。您承认并同意Plex Solution中包含机密和非公开信息，这些信息是Plex或其执照人所有的商业信息（“机密信息”）。您同意以与保障Plex权益一致的方式保障和保护Plex机密信息（和/或其许可人）的机密性，并至少努力像您保护自己的机密信息一样保护Plex的保密信息。除非本服务条款明确授权，否则，您自身不得，也不可允许任何第三方出售、转让、出版、披露或以其他方式提供保密信息的任何部分。
13. 反馈。关于Plex产品或服务或者如何改进Plex Solution，Plex欢迎您提供反馈、给出建议。向Plex传递建议、信息、材料或其他内容（统称“反馈”）的同时，您声明此类反馈不会侵犯任何第三方的知识产权或所有权（包括但不限于专利权、版权或商标权），您有权向Plex提供此类反馈而且保证Plex有权使用反馈信息。此外，收到您的反馈意见后，在没有额外任何形式的认可或顾虑的情况下，Plex会将所有反馈都视为免版税、永久、不可撤销、可转让、非排他的、可以采用、发布、复制、散布、传播、分发、复制和使用这些反馈信息，可以根据反馈信息研发媒体或技术衍生产品并在全球（或部分国家/地区）展出。对于现在已知的或以后出现的任何权利，您在此同意放弃一切与以上申明不相符的主张。
14. 移动使用。 通过您的手机或其他移动计算设备（“ Mobile Plex Solution（s）”）使用Plex解决方案提供的工具或显示功能。请注意，有关您移动设备的运营商的常规消息、数据和其他费率和费用都适用于您使用的Mobile Plex解决方案。此外，您的移动运营商可能会禁止或限制下载、安装或使用某些Mobile Plex解决方案，而且并非所有的Mobile Plex解决方案都可以与所有运营商或设备兼容或在任何地方使用。因此，您全权负责与您的移动设备的运营商联系，确定Mobile Plex解决方案是否适用于您的移动设备；弄清楚哪些会限制您使用Mobile Plex解决方案；使用的话会花费多少钱。不过，您使用Plex解决方案时应严格遵守本服务条款。
15. 与其他网站或应用程序的链接。 Plex可自行决定提供其他网站或应用程序的网络链接，包括Plex商店。Plex无法控制第三方维护那些网站。提供这些链接并不意味着Plex认可任何第三方公司或第三方网站或第三方提供的信息、产品或服务。 Plex鼓励审查适用的条款、条件或申明，进而管理这些第三方网站或应用程序的使用。
16. 第三方平台&网络。某些功能可让您跨第三方平台和网络将您的内容进行同步处理。这些功能将增强Plex解决方案的性能，同时让您可以更好地整合和协调Plex解决方案与存储在第三方网络上或与第三方网络一起使用的信息。通常情况下，使用此功能时您需要在第三方服务器上登录帐户，并且您自行承担风险。在链接或连接到Plex解决方案之前，您应该始终检查并在必要时更改这些网站和平台上的隐私设置。您明确地承认并同意Plex对任何此类第三方服务或功能承担任何责任或义务。
17. ADDITIONAL TERMS AND CONDITIONS.Additional notices, terms, and conditions may apply to certain subscription arrangements (including sign-up or registration), Plex products, solutions, or services, receipt of (or access to) certain content, participation in a particular program, and/or to specific portions or features of the Plex Solution. Without limitation of the foregoing, you hereby agree that (a) this TOS operates in addition to any terms of use imposed or required by any digital download platform from which you download the Plex Solution (“App Provider Terms”); and (b) the terms of this TOS supplement and do not alter or amend any such App Provider Terms.

20. 免责声明。 我们按“原样”和“现有”状态提供PLEX SOLUTION，并可能包含错误、遗漏或其他不准确情况。 PLEX可能在任何时候出于任何原因对PLEX SOLUTION进行修改和/或更改。除本合同规定的完成其义务的权利以外，在适用法律允许的最大范围内，PLEX明确否认所有其他明示或暗示的保证，包括但不限于任何干涉信息、安全性、非侵权性、适销性、质量或适用某种特定用途。此外，您承认并同意PLEX不担保PLEX SOLUTION不会运行任何病毒、恶意软件或有害程序软件（或代码）、无错误、不会发生中断或符合您的要求或任何法律、技术或认证标准来运行。由于PLEX SOLUTION的运行基于您的内容和数据，所以，PLEX SOLUTION的质量和性能可能存在风险。如果此免责声明以任何方式被拥有管辖权的司法法院认定为不可执行，则此类法院授予的所有明示和/或默示保证均应限于开始之日起三十（30）天内PLEX解决方案的初始阶段，并且在三十（30）天期限之后不再适用。
21. 责任限制。对于因Plex无法控制的原因导致的任何损害索赔，您明确同意Plex免于对此承担责任，包括但不限于由于Plex无法控制的硬件、文件、系统、软件、服务或网络造成的任何损害。Plex对于您或任何其他人使用任何接口软件的行为（Plex无法控制）不承担任何责任。此外，对于您通过PLEX SOLUTION访问的所有用户内容（或其它数据或内容），您自行承担与此相关的风险。您在此确认，由于您使用（或延迟使用）或未能储存通过PLEX SOLUTION获得的任何数据而导致的任何损失或损害，或其他人（包括您的授权用户）使用任何用户内容的行为，Plex不承担任何责任。此外，对于因任何人使用、延迟使用或未能使用PLEX SOLUTION导致的或与之相关的任何间接、惩罚性、附带或从属性损害赔偿，Plex在任何情况下均不承担任何责任，即使Plex已知存在发生此类损害赔偿的可能性。尽管存在上述条款，但是，Plex因违反本服务条款而承担的全部责任仅限于停止使用PLEX SOLUTION。对于因您使用PLEX SOLUTION引发或导致的任何损害赔偿，赔偿金额不超过100美元或您在近三个月内为了您个人使用PLEX SOLUTION而实际支付的总金额（二者孰高）。您和Plex同意，双方仅会以个人身份提出与本服务条款有关的投诉，不会作为集体诉讼或代表诉讼中的原告或成员。除非您与Plex另行达成协议，否则，您不得参与多人或多方诉讼。您和Plex同意，救济措施（包括金钱、禁令和宣告性救济）仅适用于个人寻求救济的情形，救济措施的范围仅限于根据个人的索赔提供救济。
22. 赔偿。您同意保护、保障并且使Plex（及其附属公司、承包商、雇员、代理、供应商和合作伙伴）免于承担任何和所有索赔、诉讼、法律程序、债务、损失、成本、损害、费用和任何其他责任，包括但不限于因您使用用户内容违反或涉嫌违反该服务条款、接口软件使用、或任何损害或涉嫌损害其他人或集体权益（包括但不限于专利权、版权或商标权）或相关行为导致的律师费用。
23. 仲裁。您在此同意，对于您与Plex因双方之间的关系而引发的全部争议（无论此类争议是否涉及第三方），包括但不限于与本服务条款、您对 Plex Solution的使用和/或隐私权和/或公开权有关的争议，双方应通过具有约束力的个人仲裁予以解决。在不限制Plex寻求禁令救济或其它衡平法救济（如下文所述）的前提下，您与Plex（“双方”）之间由于本服务条款引发的任何争议应被提交给隶属于Judicial Arbitration and Mediation Services, Inc. (“JAMS”) 的仲裁员通过仲裁解决。双方应通过联合协议选择仲裁员。如果双方在发起仲裁的一方向另一方发送书面仲裁意向通知之日起的30天内未能就仲裁员的人选达成一致，双方应各选一位隶属于JAMS的仲裁员，被选出的两名仲裁员应共同选出第三名仲裁员来解决本项争议。仲裁员应根据在提交仲裁申请时有效的JAMS/ENDISPUTE简化仲裁规则和程序解决仲裁事项。双方同意将《加州民事诉讼法》第1283.05条加入仲裁规则之中。仲裁员作出的裁决对双方具有约束力，任何拥有管辖权的法院均可将仲裁裁决作为判决。仲裁应在加州圣克拉拉县进行，在仲裁过程中应使用英语。在为了行使本服务条款之下的权利而进行的任何诉讼或法律程序过程中，胜诉方有权要求败诉方承担诉讼费用和合理的律师费。您仅可以代表自身提出索赔。您或Plex不得由于本TOS之下的任何索赔参与任何集体仲裁。本争议解决条款应符合《联邦仲裁法》的规定。
24. 适用法律。 Plex Solution由Plex在美国境内的办事处进行控制和运营。本服务条款符合加利福尼亚州的法律，并受加州法律的约束。本协议受加利福尼亚州法律的管辖，如同在加利福尼亚州订立和执行的协议一样。您可以根据自己的意愿访问和使用Plex Solution，并需遵守与访问和使用Plex Solution有关的一切适用法律。另外，Plex的总部位于美国。请注意，您提供给Plex的信息，或我们因您使用Plex Solution Plex所获得的信息可能会被传输至美国进行处理，并且受美国法律的管辖。 根据上述仲裁权利，任何与本服务条款有关的诉讼将被提交至圣克拉拉县高等法院管辖范围内的法院和加州北区美国地方法院，且签订本服务条款的各方同意受该法院的管辖。您和Plex均同意放弃由陪审团审判的权利。此外，您仅能以您个人名义提出索赔。本服务条款涵盖的任何索赔均不涉及集体诉讼或集团仲裁。如果Plex是诉讼当事人，您也同意不参与以私人检察长或代表身份提出的索赔或涉及他人账户的合并索赔。
25. 通讯和公告。根据本服务条款发送的任何通信或通知（以及任何相关资料或信息）均应使用英文，并应被视为附有以下条件：（a）如果亲自交付，则通知在交付时即被视为已送达;（b）如果通过认证或注册的美国邮件发送（要求回执），则在对方接收时被视为通知已送达；（c）如果通过主要的商业交付服务的隔日快递发送，通知在发送后一天被视为已送达； 或（d）如果发送有关终止本服务条款或普遍适用于Plex Solution终端用户的信息，通知需被发送到您指定的电子邮件地址。
26. 出口管制和法律合规。您声明并保证您不在（a）受美国政府禁运令管辖或被美国政府指定为“支持恐怖主义”的国家，和（b）在任何美国政府的受限名单中列出的国家。您在此同意：（i）您将遵守所有适用的制裁法和出口管制法，（ii）您全权负责确保Plex Solution的使用/披露和/或运输符合所有适用的制裁法和出口管制法，并且（iii）您不会以任何形式、以直接或间接方式向位于古巴、伊朗、叙利亚、苏丹、南苏丹或朝鲜的任何个人或机构出口或转让Plex Solution。
27. 执行安全措施。您不得利用Plex Solution或Plex的任何数据、系统、网络或服务参与、助长或促进非法、滥用或不负责任的行为，包括但不限于在未经授权的情况下访问或使用Plex数据、系统或网络、试图探测、扫描或测试Plex系统或网络漏洞、规避任何Plex安全或验证措施、监控Plex数据或流量、干扰任何Plex服务、通过Plex Solution收集或使用电子邮箱地址、网名或其它身份标识、在未经所有者或许可方同意的情况下通过Plex Solution收集或使用任何信息、使用任何虚假、误导性或欺骗性TCP-IP数据包标头信息、使用Plex Solution分发用于收集信息的软件或工具、发布广告或参与任何可能造成Plex或其数据、系统或网络遭受攻击的行为。实际或试图在未获得授权的情况下使用Plex Solution可能导致刑事和/或民事诉讼，包括但不限于根据美国联邦法律之下的1986年《反计算机欺诈及滥用法案》进行处罚。Plex保留在未收到您的通知或许可的情况下通过Plex Solution查看、监控并记录相关行为的权利。执法部门可以为了调查或起诉通过Plex Solution实施的犯罪或违法活动而使用Plex通过监控、审查或记录过程收集到的任何信息，Plex可以根据适用法律或相关政府部门的要求披露此类信息。Plex还会遵守与此类信息有关的所有法院命令或传票要求。此外，Plex保留在未发出通知的情况下随时变更、更新、中止、终止或中断Plex Solution的全部或部分内容的权利或中断、终止任何人对Plex Solution的访问的权利，以便保护Plex Solution或Plex的安全。
28. 禁令救济。您承认，本服务条款的实际发生的或拟将发生的任何违规行为（包括但不仅限于：未经授权使用Plex专有资产）将对Plex造成无法弥补的损失，此类损害无法用金钱损失计量，且Plex在法律上没有适当的补救措施。因此，您同意Plex除了有其他可用的补救方法之外，还有权向有管辖权的法院寻求和被授予强制令或其他适当的平衡救济，以限制任何违反、拟将发生的或实际发生的违反本服务条款项中规定的义务。因此，如果Plex寻求或被授予任何强制令或平衡救济以执行本服务条款中的规定，则您放弃要求Plex提供任何保证或其他担保的权利。
29. TERM AND TERMINATION. This TOS will take effect (or re-take effect) at the (and each) time you begin installing, accessing, or using the Plex Solution, WHICHEVER IS EARLIEST, and is effective until terminated as set forth below. Plex reserves the right to terminate this TOS at any time on reasonable grounds, which shall specifically include, without limitation, discontinuation of the Plex Solution (or related services) as an offering of the Plex business, nonpayment, termination of account, fraudulent or unlawful activity, or actions or omissions that violate this TOS, subject to the survival rights of certain provisions identified below. In addition, Plex shall have the right to take appropriate administrative and/or legal action in the event of breach or (alleged) criminal activity, including alerting legal authorities, as it deems necessary in its sole discretion. You may also terminate this TOS at any time by providing Plex with notice of cancellation, but all applicable provisions of this TOS will survive termination, as identified below. You may close your account by clicking here. Upon termination and in accordance with law, your right to access and use the Plex Solution shall cease (regardless of the subscription period) and you must immediately destroy all copies of any aspect of the Plex Solution in your possession. Termination shall result in deactivation or deletion of your account with Plex. The provisions concerning Content, License Grant Restrictions, Proprietary Rights, Permission to Use User Content, Proprietary Rights, Feedback, Confidentiality, Additional Terms and Conditions, Disclaimer of Warranty, Limitation of Liability, Indemnification (for a period of one year after termination), Arbitration, Governing Law, Enforcing Security, Injunctive Relief, Term and Termination, Waiver & Severability, and Entire Agreement will survive the termination of this TOS for any reason. Further, Plex shall not be responsible for any damage that may result or arise out of termination of this TOS.
30. 弃权和可分割性。Plex没有严格执行本服务条款项下的任何规定的情形不应被理解为Plex放弃针对任何后续违约或不履约行为采取措施的权利。Plex对本服务条款项下任何权利的放弃不应被视为放弃任何其他权利或条款，或在任何其他时间放弃相同的权利或条款。如果根据适用法律确定本服务条款的任何部分无效或不可执行，包括但不仅限于：免责声明、审判地、索赔和责任限制，则无效或不可执行条款应被视为已被替代，替代条款应有效、可执行，其意图应与原条款保持一致，并且，本服务条款的其它内容仍保持有效。
31. 完整协议。您与Plex之间不会因为本服务条款或您对Plex Solution的使用而产生任何合资企业、合作伙伴关系、雇佣或代理关系，并且您无权以任何方式约束Plex。本服务条款代表您和Plex之间关于您个人使用Plex Solution的完整协议。除Plex事先书面同意外，本服务条款不可分配、转让或转授权。Plex可能会在未经同意的情况下分配、转让本服务条款及其权利和义务，或将相关权利和义务授予其他方。 请注意，Plex保留变更本服务条款的权利，以及Plex Solution及其产品通过在线发布修改后的服务条款或通过邮寄和/或电子邮件的方式向您发送通知所适用的条款。此外，Plex可能会添加、修改或删除Plex Solution的任何方面、程序、功能或特性。在任何添加、修改或删除之后，您继续使用Plex Solution将被最终视为接受本服务条款中的规定。因此，请定期查看此处的服务条款。
